At the time of purchase, the risk of the object of sale transfers to the winning bidder.
In the event of a legal dispute, regardless of the reason or cause, the court with jurisdiction over the seller's current address shall be the exclusive court of first instance, and the bidder agrees to bid with the understanding that legal action will be filed in that court. This exclusive jurisdictional agreement shall apply even to matters outside of this transaction.
If a lawsuit is heard in a court other than the court with jurisdiction over the seller's current address, the winning bidder shall be obligated to withdraw the lawsuit and waive the rights that are the subject of the lawsuit.
The seller may cancel the transaction at any time for the seller's convenience without the buyer's consent.
Cancellation can be done by the seller without notice and regardless of whether the winning bidder is at fault.
In any dispute arising from this transaction, the maximum amount of damages the winning bidder can claim, regardless of claims for breach of contract or tort, shall be limited to the total of the winning bid and shipping costs.
The winning bidder shall bear the costs of restoring the original condition due to cancellation, and other similar expenses.
When pursuing the seller's responsibility, the winning bidder shall bear the burden of proof for any claim and shall be required to provide proof beyond a reasonable doubt.
The winning bidder shall bear all responsibility for any issues specific to transactions between parties, regardless of where the responsibility lies.
If any monetary exchange, such as a refund, is required due to any circumstances arising from this contract, the exchange shall be conducted between accounts of Japan Post Bank, regardless of whether the seller is at fault.
If the winning bidder needs to ship an item to the seller for any reason, the seller shall select the shipping method, regardless of whether the seller is at fault for the circumstances.
If the winning bidder needs to ship an item to the seller for any reason, and the seller is at fault for the circumstances, the seller shall only be required to pay the shipping costs to the winning bidder, and the seller shall not have any claims against the winning bidder for any other actions necessary for the shipment, such as packaging and shipping.
